Publishers' Outrage Against AI Overviews: Antitrust Complaint Filed Against Google in EU.

Search giant Google is facing a new antitrust complaint in the European Union. A group of independent publishers alleges that Google's "AI Overviews" are causing "significant harm" to their website traffic, readership, and revenue. The complaint was filed with the European Commission by the Independent Publishers Alliance, which is also seeking an interim measure to prevent what they call "irreparable damage."

Google's AI Overviews are AI-generated summaries displayed prominently above traditional search result hyperlinks in over 100 countries. Complaining publishers claim that Google is "misusing" their web content to create these summaries. More critically, publishers allege they have no option to stop their content from being used for AI training or AI Overviews if they wish to maintain their visibility in Google's general search results. This effectively forces them to permit content usage while simultaneously experiencing a direct decline in their traffic. It's also noted that advertisements have been integrated into AI Overviews since May.

Documents seen by Reuters, dated June 30, reveal that the Independent Publishers Alliance accuses Google of abusing its market dominance in online search. They argue that by placing its own AI-generated summaries at the top of search results, Google is shortchanging publishers' original content, leading to fewer clicks and a reduction in advertising revenue.

This complaint echoes concerns raised by other content providers globally as Google places its "biggest bet" by directly integrating AI into its search functions. News organizations and other publishers increasingly fear that AI Overviews reduce the need for users to click through to their websites, thereby undermining their business models. Some third-party reports and analyses have shown a significant decrease in click-through rates when AI Overviews are present.

In response to the allegations, a Google spokesperson stated that the company "sends billions of clicks to websites every day" and that "new AI experiences in Search enable people to ask more questions, which creates new opportunities for content and business discovery." Google further maintained that claims of traffic loss are often based on "highly incomplete and biased data," which can be influenced by various factors including seasonal demand and algorithm updates.

However, the Independent Publishers Alliance, which is supported by organizations like the Movement for an Open Web and the British non-profit Foxglove Legal Community Interest Company, insists that an interim measure is urgent to protect competition and ensure public access to diverse news sources. Foxglove's Co-Executive Director, Rosa Curling, emphasized that Google's AI Overviews pose "an existential threat to independent news" and urged regulators worldwide to enforce opt-out options for publishers.
