Elon Musk Criticizes OpenAI Security; New Controversy in Court Testimony

Technology entrepreneur Elon Musk has reignited controversy in an ongoing lawsuit against the artificial intelligence company OpenAI. In a recently released deposition, he raised concerns about OpenAI’s security record and claimed that his own initiative, xAI, places greater emphasis on safety.

In the deposition, Musk said, “No one has committed suicide because of Grok—but there have been such claims regarding ChatGPT.” His remarks have already sparked significant discussion in the tech community.

The comments relate to an open letter published in March 2023. The letter called for at least a six-month pause in developing AI models more powerful than GPT-4. Over a thousand people, including AI experts, had signed it, warning that developing AI without adequate regulations and controls was turning into an ‘uncontrolled race.’

Meanwhile, multiple lawsuits have been filed against OpenAI alleging that the nature of ChatGPT’s interactions has negatively impacted the mental health of some users, with a few cases reportedly leading to suicide. Although these claims are still under judicial review, Musk’s statements suggest that he might use them in the litigation.

Musk’s video testimony was taken last September but released publicly this week ahead of the upcoming jury trial. The core issue in the lawsuit concerns OpenAI’s transition from a nonprofit research organization to a for-profit company. Musk claims that this change violated prior ethical agreements, alleging that commercial partnerships may prioritize speed and revenue over safety.

However, scrutiny has not been limited to OpenAI; Musk’s own ventures have also come under criticism. Recently, on his social media platform X, some unauthorized nude images—including alleged images of minors—were circulated via Grok. The California Attorney General’s office has opened an investigation, and the European Union along with other countries are reviewing the matter.

In his deposition, Musk said that he initially signed the open letter calling for caution in AI development because it seemed prudent—not for competitive advantage. He also stated that artificial general intelligence (AGI) carries inherent risks and safety should be prioritized.

Musk admitted that previous statements regarding his donations to OpenAI were inaccurate. While he had initially reported donating $100 million, the corrected documentation states the amount as approximately $44.8 million.

Explaining the context behind OpenAI’s founding, Musk said that he was concerned about Google potentially monopolizing AI. In discussions with Google co-founder Larry Page, he felt that sufficient attention was not being given to AI safety. This prompted him to establish OpenAI to create a balance.

Analysts suggest that this lawsuit is not merely a dispute between two companies; rather, it raises broader questions about balancing safety, policy, and commercial interests in the rapidly growing AI industry. The upcoming trial may provide crucial guidance on these issues.
